Terms of Service

Establishing the professional standards and operational protocols that govern our global technology partnerships.

1. Acceptance of Terms

By accessing the Lomcos website or utilizing our professional technology services, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you ("the Client" or "User") and Lomcos Corporation Private Limited If you do not agree to these terms, you must cease all use of our platform and services immediately.

2. Scope of Services

Lomcos provides enterprise-grade solutions across several domains. The specific delivery of these services is governed by individual Service Level Agreements (SLAs) or Project Contracts:

  • Software Engineering: Custom web, mobile, and system architecture development.
  • AI & Intelligence: Integration of advanced machine learning and automation frameworks.
  • Blockchain Architecture: Development of decentralized ledgers and smart contract systems.
  • IT Consulting: Strategic digital transformation and infrastructure optimization.

3. Intellectual Property

Unless otherwise specified in a signed bilateral agreement:

  • Lomcos IP: All base frameworks, proprietary methodologies, and platform designs remain the exclusive property of Lomcos.
  • Custom Deliverables: Intellectual property rights for custom-coded solutions are transferred to the Client upon full payment of all contractual fees, subject to the retention of non-identifiable base components by Lomcos.
  • Trademarks: The Lomcos name, logo, and "Architecting Digital Infinity" slogan are protected trademarks.

4. User Obligations

Users of our platform and services are prohibited from:

  • Reverse engineering any proprietary software provided by Lomcos.
  • Utilizing Lomcos infrastructure for illegal data processing or unauthorized security testing.
  • Misrepresenting their affiliation with Lomcos to third parties.
  • Bypassing any technological safeguards integrated into our delivery platforms.

5. Limitation of Liability

Lomcos Technology Solutions shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our services. While we architect for 99.9% reliability, we do not warrant that services will be absolutely uninterrupted or error-free due to the nature of global network dependencies.

Professional Indemnity

Our total liability for any claim arising out of these terms shall not exceed the amount paid by the Client to Lomcos for the specific service in question during the twelve (12) months preceding the claim.

6. Termination of Service

Lomcos reserves the right to terminate access to our services or platforms without prior notice if a breach of these terms is identified. Upon termination, all licenses granted to the User for Lomcos proprietary software shall cease immediately.

For project-based services, termination protocols defined in the specific Project Agreement shall take precedence over these general terms.

7. Governing Law

These terms are governed by and construed in accordance with the laws of the jurisdiction where Lomcos Corporation Private Limited is registered. Any disputes shall be subject to the exclusive jurisdiction of the competent courts within that region.
